Cyber Media Guidelines

Freedom of speech, expression, and press are human rights fundamental that are protected by Pancasila, 1945 Constitution, and Universal Declaration of Human Rights by United Nations. The presence of cyber media in Indonesia is also part of freedom of speech, expression, and press.

Cyber media have a special character so need guidelines. So that, the operations can be carried out in a professional manner, fulfilling the functions, rights and obligations according to UU 40/1999 (Republic of Indonesia) concerning the press and journalistic code of ethics. To that end, Press Council and press organization, cyber media manager, and communities devise guidelines for news coverage by cyber media as follows:

1.  Scope

a. Cyber Media is any form of media that uses internet and carrying out journalistic activities, as well as meet requirements of legislation and standards of the press company Press Releases assigned a Press Council.

b. User Generated Content is any content created or published by users and cyber media, among others, articles, pictures, comments, sounds, videos and upload various forms attached to cyber media such as blogs, forums, comments by reader or Viewer, and other forms.

2.  Verification and equality news

a. in principle every news has to go through verification.

b. News that can harm the other party requires verification on the same news to meet principles of accuracy and equality.

c. Provision in point (a) above are excluded, provided:

1) News contains of public interest which are urgent;

2) First news source is a clearly mentioned credentials, credible and competent;

3) News subject must be confirmed and its whereabouts are unknown or unable to be interviewed;

4) Media provides an explanation to readers if news still require further verification that will in time as soon as possible. Explanation(s) contained in final part of the same news, inside the brackets and use italics.

d. After news release in accordance to point (c), media is obligated to forward efforts of, and after verification is obtained, the results are listed on a news update with a link on news that has not been verified.

3.  User Generated Content

a. Media are obligated to apply terms and conditions regarding User Generated Content which are not contrary to UU 40/1999 (Republic of Indonesia) concerning press and tournalistic code of ethics, which indicated clearly.

b. Cyber Media oblige each user for membership registration and log-in processes in advance to be able to publish all forms of User Generated Content. Provisions on log-inwill be regulated further.

c. In registration, cyber media oblige users to give written consent that User Generated Content published:

1) Does not publish contents of a lie, slander, sadistic and obscene;

2) Does not publish content(s) that contain of prejudice and hatred associated with ethnic, religion, race, and interracial group, as well as encouraging acts of violence;

3) Does not publish contents of discriminating based on gender and language, and not degrading person’s weak, poor, sick, or physical disability.

d. Cyber Media have absolute authority to edit or delete a User Generated Content that goes against the point (c).

e. Cyber Media are obliged to provide a mechanism for making complaint(s) about User Generated Content that is judged to violate provisions of point (c). The mechanism should be provided in a place easily accessible to user(s).

f. Cyber Media obliged to edit, delete, and otherwise act in any corrections of User Generated Content that reported and violated the provisions of points (c), as soon as possible proportionally, no later than, 2x24 hours after complaint received.

g. Cyber Media that meet those conditions in points (a), (b), (c), and (f) not burdened responsibility for problems caused due to publish of contents that violate the provisions of point (c).

h. Cyber Media responsible for content that was reported otherwise to correct it after the deadline as the point (f).

4.  Errata, Corrections, and Right Answer

a. Errata, corrections, and right answer refers to Press Act, code of ethics of journalism, and guidelines set out by Press Council.

b. Errata, corrections and right answer linked on the news which were revised, corrected or that given the right answer.

c. In every news errata, corrections, and right answer is obliged to enclose release time of errata, corrections, and or right answer.

d. If a certain cyber media news disseminated by other cyber media, then:

1) Responsibilities are limited to news published in cyber media or media that are under the technical authority;

2) Corrections made by a cyber media, should also be done by other cyber media quoting news from the cyber media that are corrected;

3) Media that disseminate news from a cyber media and do not make corrections over news as is done by cyber media owner and or news makers, are entirely responsible for all legal consequences of the news that is not corrected.

e. In accordance with the law of press, cyber media does not serve right answer can be subject to criminal law penalties and a maximum fine of Rp 500.000.000,- (five hundred million rupiah).

5.  Repeal News

a. News already published cannot be revoked for reasons of censorship of outside parties, except editorial related issues of ethnic, religion, race, and interracial group, morality, future of children, traumatic experiences or other special considerations based on assigned by Press Council.

b. Other Cyber Media are obligated to revoke quotations from original media has been revoked.

c. Repeal of news must be accompanied with reason(s) and notified to public.

6.  Ads

a. Cyber Media obliged to distinguish unequivocally between news and ads content.

b. Any news/articles/content which is advertising and/or paid content are obliged to apply description advertorial‘, ads‘,sponsored‘, or other words that explained that the news/articles/contents is advertising.

7.  Copyright

Cyber Media is obligated to honor copyright as set forth in applicable legislation.

8.  Disclosure of Guidelines

Cyber Media are obliged to disclose Cyber Media Guidelines in its medium clearly.

9.  Dispute

Final assessment over dispute regarding the implementation of Cyber Media Guidelines are finalized by Press Council.
